This Privacy Policy explains how Cybertech Solutions (ACN 631 941 841, ABN 70 631 941 841) (“we”, “us”, “our”) handles your personal information in connection with the Sequal App application and website (the “Service”). Sequal App is a registered business name of Cybertech Solutions. We are committed to protecting your privacy in accordance with the Privacy Act 1988 (Cth) (the “Privacy Act”) and the Australian Privacy Principles (“APPs”).
By using the Service, you agree to the collection and use of information in accordance with this policy.
1. Personal information we collect
We collect only what we need to provide the Service. Depending on how you use it, this may include:
- Account details — your name, email address and, if you choose to provide them, a mobile number. If you register with email, we store a securely hashed password (never the password itself).
- Sign-in identifiers — if you sign in with Google or Apple, we receive and store an identifier from that provider and your email/name as supplied by it.
- Security data — if you enable multi-factor authentication, the data needed to operate it; and counters used to protect against repeated failed logins.
- Your content — the activities, groups, sequences, programs, tags and media you create, and your workout history (what you played and when). This stays on your device unless you turn on cloud sync.
- Preferences — app settings such as your theme.
- Billing data — if you subscribe, a customer identifier from our payments provider. We do not store your full card details (see “Payments”).
- Technical and usage data — limited information needed to run and secure the Service, such as an IP address recorded when you make a change (create, update or delete) for security and audit purposes, and the platform and app version your device reports when checking for updates.
2. Analytics, error reporting and consent
We do not collect analytics or error-reporting data by default. Optional diagnostic telemetry (used only to find and fix crashes) is off unless you opt in, and is configured to strip personal information. You can change your choice at any time. We do not sell your personal information, and we do not use it for advertising profiles.
3. How we collect it
- Directly from you — when you create an account, build content, contact us or subscribe.
- Automatically — limited technical data as described above, when you use the Service.
- From third parties — from Google or Apple if you use them to sign in, and from our payments provider in relation to your subscription.
4. Why we use your information
We use personal information to:
- provide, operate and maintain the Service and your account;
- sync and back up your library if you enable cloud sync;
- process subscriptions, refunds and related communications;
- keep the Service secure and prevent abuse;
- respond to your enquiries and provide support;
- comply with our legal obligations.
We will only use your information for a purpose you would reasonably expect, or as otherwise permitted under the APPs.
5. Who we share it with
We do not sell your personal information. We share it only with service providers who help us run the Service, and only as needed:
- Payments — Polar, our Merchant of Record, processes subscription payments and handles your card details.
- Sign-in — Google and Apple, if you choose to use them to authenticate.
- Hosting & storage — our cloud hosting provider (for the application and database) and Cloudflare (for media storage), if you use cloud sync.
- Email — our email delivery provider, for transactional messages such as verification and account notices.
- Document & email generation — our template-rendering service, used to produce emails and documents.
We may also disclose information where required or authorised by law.
6. Overseas disclosure (APP 8)
We are based in Queensland, Australia, but our infrastructure providers store and process data outside Australia. This means that, if you use cloud sync, your information (including a copy of your content and media) may be stored or processed in countries including the United States, the European Union and Singapore, and via Cloudflare’s global network. By using cloud features, you consent to this overseas disclosure. We take reasonable steps to ensure overseas recipients handle your information consistently with the APPs.
7. Payments
Subscriptions are processed by Polar as Merchant of Record via a secure web checkout. Your card details are handled by Polar, not by us; we receive only the information needed to manage your subscription (such as a customer identifier and subscription status). There are no in-app purchases.
8. How we protect your information (APP 11)
We take reasonable steps to protect personal information from misuse, interference, loss, and unauthorised access, modification or disclosure — including hashed passwords, access controls and audit logging of changes. No method of transmission or storage is completely secure, however, and we cannot guarantee absolute security.
9. How long we keep it
We keep personal information only as long as needed for the purposes above or as required by law. Key retention periods (such as the 30-day grace period after a subscription ends, and the cooling-off period for account deletion) are described in our Data & Retention Policy.
10. Accessing and correcting your information (APP 12 & 13)
You can view and edit most of your information directly in the app. You may also ask us to access or correct the personal information we hold about you by emailing contact@sequal.app. We will respond within a reasonable time and may need to verify your identity first.
11. Deleting your account and data
You can request deletion of your account from within the app. After a 30-day cooling-off period (during which you can cancel the request by signing in), we anonymise your personal details — including your name, email, mobile number and sign-in identifiers — and remove your cloud-stored content. We may retain limited records where required by law (for example, transaction records for tax and accounting). Content stored only on your device remains there until you remove it.
12. Children
The Service is not directed to children under 12. If you are under 12, please do not use it. For users under 15, we encourage involvement of a parent or guardian, and app-store age ratings also apply. If you believe a child has provided us personal information without appropriate consent, contact us and we will take steps to delete it.
13. Communications and marketing
We send transactional messages (such as verification and account notices) as part of providing the Service. We will only send promotional messages with your consent, and you can opt out at any time.
14. Cookies and local storage
Our website does not set tracking cookies or load third-party trackers. The app stores data on your device to function (such as sign-in tokens and your preferences). See our Cookie & Tracking Notice for details.
15. Complaints
If you have a privacy concern, please contact us first at contact@sequal.app so we can try to resolve it. If you are not satisfied with our response, you may contact the Office of the Australian Information Commissioner (OAIC) at oaic.gov.au.
16. Changes to this policy
We may update this policy from time to time. We will post the updated version here and change the “Last updated” date above. Significant changes will be communicated where appropriate.
